| dc.description.abstract | Niniejszy tekst dotyczy kwestii zażalenia na postanowienie w sprawie zawieszenia postępowania na podstawie art. 101 § 3 kodeksu postępowania administracyjnego. Podjęta zostaje analiza tekstu ustawy sprzed i po nowelizacji z dnia 3 grudnia 2010 r. z uwzględnieniem utrwalonych stanowisk doktryny oraz orzecznictwa, aby odpowiedź na pytanie o zasadność nowelizacji, jej praktyczny skutek oraz problem w stosowaniu z uwagi na istniejący rozłam w zakresie interpretacji treści zmienionego przepisu. W tekście sformułowano pod koniec wnioski de lege ferenda mając na uwadze jasność i pewność przepisów oraz usunięcie legislacyjnego przeoczenia w postaci zwrotu „w sprawie”. | pl |
| dc.description.abstract | This text deals with the issue of a complaint against a decision to suspend proceedings pursuant to Article 101 § 3 of the Code of Administrative Procedure. An analysis of the text of the Act before and after the amendment of 3 December 2010 is undertaken, taking into account the well-established positions of the doctrine and the case law, in order to answer the question about the legitimacy of the amendment, its practical effect and the problem of application due to the existing split in the interpretation of the content of the amended provision. At the end, the text formulates de lege ferenda conclusions with a view to clarity and certainty of the provisions and the removal of a legislative omission in the form of the phrase 'in a case'. | en |
