Abstract
Autor czyni rozważania na temat tego, czy znana w obecnym kształcie procedura powoływania i odwoływania wiceprezesów(-ek) Najwyższej Izby Kontroli sprawia, że będzie można stwierdzić ich niezależność względem przede wszystkim polskiej władzy wykonawczej, ale też innych środowisk, które NIK może kontrolować. W tym celu autor opisuje procedurę powoływania na to stanowisko oraz odwoływania z niego i stara się wypunktować możliwe zagrożenia dla zachowania pełnej niezależności samej procedury, a także konkretnych osób powoływanych bądź odwoływanych z funkcji wiceprezesa(-ski) NIK-u, biorąc pod uwagę między innymi ustrojowe uwarunkowania polskiego systemu politycznego. Zauważywszy zagrożenia, autor de lege ferenda proponuje wprowadzenie odpowiednich rozwiązań prawnych mających na celu zminimalizowanie możliwości wpływu różnych środowisk, które NIK może kontrolować, na samą procedurę powoływania i odwoływania jej wiceprezesów(-ek), a także na konkretne osoby mające zająć bądź utracić to stanowisko.In the article, the author deliberates whether the procedure of appointing and dismissing vice-presidents of Polish Supreme Audit Office (SAO, NIK) is both de iure and de facto independent from the Polish executive and any other institutions which can be controlled by the SAO. That is why the author describes the procedure of appointing and dismissing the vice-presidents of the SAO and, through de lege lata conclusions, tries to point out possible threats to the full independence of the procedure itself as well as the specific persons participating in this procedure. The analysis takes into account constitutional conditions of the Polish political system and how — for example — the Polish Government is appointed. Noticing the threats, the author proposes de lege ferenda to introduce into law legal solutions aiming to minimize the possibility of the governing party (parties), among other entities, influencing the described procedure.
