dc.description.abstract	Artykuł przedstawia ramy instytucjonalne dotyczące dowodu z opinii biegłych w postępowaniach sądowych, administracyjnych i administracyjnosądowych. Autor przedstawia ustrojową pozycję biegłego, charakter prawny opinii przez niego sporządzanej oraz wypływające z tego skutki dla jej kwalifikacji jako dokumentu urzędowego w rozumieniu przepisów ustawy o dostępie do informacji publicznej. W artykule wskazano poglądy judykatury i doktryny na tę kwestię. W ocenie autora problemy z kwalifikacją opinii jako informacji publicznej wynikają z braku całościowego uregulowania instytucji biegłego w polskim porządku prawnym. Dopiero uregulowanie tej kwestii wyeliminuje problemy z tym związane.	pl
dc.description.abstract	The article presents the institutional framework for evidence from expert opinions in judicial, administrative and administrative court proceedings. The author presents the systemic position of the expert, the legal nature of the opinion prepared by him and the resulting consequences for its classification as an official document within the meaning of the provisions of the Act on access to public information. The article indicates the views of the jurisprudence and doctrine on this issue. In the author’s opinion, problems with the classification of an opinion as public information result from the lack of comprehensive regulation of the institution of an expert in the Polish legal system. Only the regulation of this issue will eliminate the problems associated with it.	en
