Abstract
Celem niniejszego artykułu jest przedstawienie występowania instytucji dekretu w poszczególnych okresach polskiej państwowości. W tekście opisany został rodowód samej instytucji wywodzący się z okresu pryncypatu w starożytnym Rzymie oraz przejęcie i upowszechnienie na ziemiach polskich dekretu za sprawa średniowiecznej kanonistyki. W dalszej części opisana została instytucja dekretu w okresie przedrozbiorowym, Księstwa Warszawskiego i Królestwa Polskiego. Następnie opisane zostały dekrety wydawane przez Radę Regencyjną, Naczelnika Państwa i Prezydenta Rzeczypospolitej, wraz z ich prawnym umocowaniem. W artykule opisane zostały również dekrety wydawane w okresie powojennym przez Polski Komitet Wyzwolenia Narodowego, Rząd Tymczasowy Rzeczpospolitej Polskiej, Tymczasowy Rząd Jedności Narodowej oraz Rząd Rzeczypospolitej i Radę Państwa wraz z ich prawnym umocowaniem.The aim of this article is to present the occurrence of the institution of decree in particular periods of Polish statehood. The text describes the origins of the institution itself, dating back to the period of the principate in ancient Rome, as well as the adoption and dissemination of the decree in Polish lands in the matter of medieval canonism. The following section describes the institution of the decree in the pre-partition period of the Duchy of Warsaw and the Kingdom of Poland. Then, the decrees issued by the Regency Council, the Chief of State and the President of the Republic of Poland were described, along with their legal authorization. The article also describes the decrees issued in the post-war period by the Polish Committee of National Liberation, the Provisional Government of the Republic of Poland, the Provisional Government of National Unity and the Government of the Republic of Poland and the Council of State, along with their legal authorization.
